The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 307, 353, 188, 295(A), 504, 506 of the Indian Penal Code and Section 3/4 of the Explosive Substance Act.

The allegation against the petitioner is that during immersion of idol, hot exchange and violence took place between the police party and local persons, lead by the petitioner, in which illegal arms have been recovered from the accused persons and 31 persons were apprehended by the police.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.10.2016. The charge sheet has

There is no allegation of tampering of witnesses alleged against the petitioner. No specific injury has been attributed against the petitioner nor any overt act has been alleged against him.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari, in connection with Sugauli P.S. Case No. 218 of 2016.
