JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant.

According to prosecution case, the informant was raped on 01-05-2014 but admittedly, the present case was lodged on 10-052014. Although the informant has given some explanation for the aforesaid delay but admittedly, the petitioner happens to be agnate of the informant and furthermore, the medical report does not support the story of rape.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Isuapur P.S. Case No. 42 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra.
