1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Ismailpur Police Station Case No. 115 of 2023, disclosing offences under Sections 341, 323, 354(B), 504, 506 of the Indian Penal Code.
3. As per the First Information Report, on the date of occurrence, the petitioner abused the informant and her husband, misbehaved with her and in the night when the informant's husband was not at home. Petitioner entered into informant's room and outraged her modesty.
4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to the fact there is land dispute between the petitioner and informant's husband and the FIR has been lodged
Patna High Court CR. MISC. No.12212 of 2024(2) dt.12-03-2024 2/2 after a delay of eight days. The informant is sister-in-law of the petitioner and her husband is his own brother. The witnesses during the course of investigation have not supported the prosecution story.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the specific allegation made by the informant in the FIR, I am not inclined to grant the petitioner privilege of anticipatory bail.
