JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner happens to be husband of the deceased. The case was, originally, registered under Section-304B of the Indian Penal Code but police after investigation, submitted charge sheet u/S 306 of the Indian Penal Code though there was allegation of demand of dowry and torturing and the death of the deceased occurred within two years of her marriage at her matrimonial home and her death was unnatural. Therefore, considering the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail

Patna High Court Cr.Misc. No.48171 of 2014 (4) dt.16-04-2015 in connection with Ahiyapur P.S. Case No. 50 of 2014 corresponding to Sessions Trial No. 404 of 2014 pending in the court of Learned Additional Session Judge-VII, Muzaffarpur stands rejected.
