JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section-273 of the Indian Penal Code and Section30(a) of the Bihar Excise (Amendment) Act, 2016. Allegedly, 7 litres 200 ml. country-made liquor has been recovered from possession of the petitioner. The seizure list enclosed with the written report does not bear the signature of the petitioner. The petitioner is said to be in custody since 17-102016. It is mentioned at paragraph-3 of the petition that the petitioner has got no criminal antecedent.
Considering the above-said facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
Patna High Court Cr.Misc. No.4447 of 2017 (2) dt.13-02-2017 2/2 sureties of the like amount each in connection with Bakhtiarpur Rail P.S. Case No. 106 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Patna subject to condition that both the bailors will be close relatives of the petitioner.
