The petitioner seeks bail in Barauli P.S. Case No. 112 of 1995, corresponding to Sessions Trial No. 53A of 2006, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

The petitioner was on bail, but his bail bond was cancelled on 25.08.2001, during the course of evidence. The petitioner misused the privilege of bail for 13 years and for that the petitioner is in jail since 16.04.2014. The petitioner has remained in jail for one year for misuse of privilege of bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.35057 of 2014 (6) dt.16-04-2015 2/2 each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S. Case No. 112 of 1995, corresponding to Sessions Trial No. 53A of 2006, subject to the condition that the petitioner shall physically appear on each and every date and if the petitioner does not appear on two consecutive dates without any good ground, the learned court below shall cancel the bail bond of the petitioner.
