The petitioner seeks bail in Special Case No. 47 of 2012, arising out of Digha P.S. Case No. 211 of 2012, registered for the offences punishable under Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act. From the perusal of the records it appears that of course 20 puriyas each containing smack/brown sugar were recovered but the police did not weigh the recovered brown sugar. The petitioner is in jail since 14.12.2012. The petitioner has remained in jail for 2 1⁄2 years.

Considering the facts aforesaid and the fact that in absence of weighing the recovered articles and particularly the fact that how much amount of brown sugar was recovered from the

No.39161 of 2014 (5) dt.16-04-2015 2/2 possession of the petitioner has not been mentioned in the entire case diary, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Danpal Singh, the learned Additional Sessions Judge VII, Patnacum- Special Judge, NDPS Act, Patna in connection with Special Case No. 47 of 2012, arising out of Digha P.S. Case No. 211 of 2012.
