Petitioner happens to be husband of the deceased and is languishing in jail custody since 26.10.2014 in a case in which charge sheet has been submitted under section 304B/34 of the Indian Penal Code.

It is an admitted position that marriage of the deceased had taken place in the month of June, 2013 and she died at her parental home on 23.3.2014. Furthermore, in course of investigation, witnesses stated that the deceased remained at her matrimonial home only for 31 days and she was residing at her parental home since last 6 to 7 months.

The contention on behalf of the petitioner is that deceased was not happy with her marriage and she was not ready to return to

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Desari P.S.
