The petitioner seeks bail in a case instituted for the offence under Sections 30A and 13 of Bihar Excise Act. It is alleged that 18 litres of Bengal made liquor was recovered from possession of this petitioner. The petitioner has been arrested on same day on 31.12.2016 and since then he is in custody.

Keeping in view the period spent by the petitioner in custody, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S.

Patna High Court Cr.Misc. No.4565 of 2017 (2) dt.15-02-2017 2/2 Case No. C-1 No. 1246 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner. The petitioner is directed to file an affidavit in the court below that he will not indulge in such type of activity in future and in the event he is found indulging in such type of activity, his bail bond will be cancelled.
