JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-02-2019 At the outset, the learned counsel for the petitioners seeks to make correction in paragraph-10 of the bail petition. Let the same be done during course of the day. Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with G.O. Case No. 05 of 2019 arising out of Sadar P.S. Case No. 03 of 2019 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 9.875 liters of illicit liquor from a dilapidated house.

The learned counsel for the petitioners submits that

It is further submitted that the petitioners have no concern with the said shambles house and the petitioners are having a clean antecedent and are languishing in custody since 02.01.2019. Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned A.D.J. Vth- cum- Special Judge (Excise Act), Darbhanga in connection with G.O. Case No. 05 of 2019 arising out of Sadar P.S. Case No. 03 of 2019.
