JUSTICE RAKESH KUMAR ORAL ORDER 17-12-2015 Heard Sri Sanjeev Kumar Singh, learned counsel for the petitioner and Sri Dilip Kumar, learned A.P.P. The petitioner who is in custody since 24.8.2015 in connection with Dagarua P.S. Case No. 183 of 2015 registered for the offence under Section 394 of the India Penal Code has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner's name has come on the basis of confessional statement of the co-accused and recovery of one looted SIM was shown from the shop of the petitioner. He submits that petitioner was running a shop of mobile and as such petitioner has falsely been implicated. He further submits that petitioner is having clean antecedent.

Patna High Court Cr.Misc. No.55274 of 2015 (2) dt.17-12-2015 2/2 Learned A.P.P. has opposed prayer for bail.

Besides hearing , I have also perused the materials available on record. On going through the impugned order it is evident that besides recovery of looted SIM, on disclosure statement made by the petitioner, a looted motorcycle was also recovered.

In view of fact that disclosure by the petitioner has led to recovery of looted motorcycle, the court is not inclined to extend the privilege of bail.

The petition stands dismissed.
