JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-02-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Nawada Nagar (Bundelkhand) P.S. Case No. 807 of 2020 registered for offence punishable under section 414 of the Indian Penal Code.

The name of the petitioner has been figured in confessional statement of Vikash Kumar and from whose possession, a stolen motor cycle was recovered. Vikash Kumar disclosed that the person, who was sitting as pillion rider on that motor cycle, was the present petitioner.

The learned counsel for the petitioner has submitted that

No.19871 of 2021(3) dt.23-02-2022 2/2 Raushan Kumar, from whom a stolen motor cycle was purchased for consideration money of Rs.13,500/-, has been granted anticipatory bail by a Co-ordinate Bench in Criminal Miscellaneous No. 8142 of 2021, vide order dated 01.12.2021. The criminal antecedent of the petitioner was called for, which was received through letter no. 634 of the Superintendent of Police, Nawada, which shows that the petitioner has no criminal antecedent.

Considering the above mentioned facts and circumstances, let the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada Nagar (Bundelkhand) P.S. Case No. 807 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
