JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner happens to be brother-in-law of the deceased, who had gone to the house of the petitioner to take back his wife but allegedly, she was killed by the petitioner and other accused. The postmortem report of the deceased reveals that cause of death of the deceased was strangulation. Moreover, there is no eye witness of the alleged occurrence and the only circumstance against the petitioner is that dead body of the deceased was found in his house and the own sister of the petitioner has made confessional statement, disclosing the involvement of the petitioner in the alleged crime.

Patna High Court Cr.Misc. No.2358 of 2015 (3) dt.16-04-2015 2/2 Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chanpatiya P.S. Case No. 403 of 2013 to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran.
