The petitioner is languishing in custody since 11.12.2018 in a case registered for the offences punishable under Sections 498A,497 and 379/34 of the I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.

The prosecution case as per the written report of Munni Devi, submitted to the SHO, Bhojpur, Ara Police Station is to the effect that the informant was married with the petitioner on 28.5.2011. For two months, the informant led peaceful life but thereafter, further dowry demand of Rupees Three Lacs was made and for non-fulfillment of the same, torture was inflicted upon the informant and she was being assaulted. It is further alleged that on 20.12.2015, after snatching all her belongings, the informant was driven out of her matrimonial house.

Patna High Court Cr.Misc. No.9323 of 2019(2) dt.18-02-2019 2/2 It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and birth of a female child and it is the informant who deserted the petitioner.

Learned counsel for the informant submits that the petitioner has performed second marriage, as a result of which, torture was inflicted upon the informant and she has been reduced to a destitute.

Considering the nature of accusation and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Ara in connection with Bhojpur Mahila P.S. Case No.16 of 2017.

However, with regard to maintenance, the informant is at liberty to agitate the issue before the appropriate forum. (Dinesh Kumar Singh, J) anil/- U
