JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly, no one has seen the actual killing of the deceased and in course of investigation, when call details of mobile of the deceased was taken out, it was detected that petitioner had used the mobile set of the deceased putting his own sim in the said mobile. The petitioner was arrested and confessed his guilt and thereafter, the mobile set of the deceased was recovered.

Considering the facts and circumstances of the case as well as materials available on the case diary, I am not inclined

Patna High Court Cr.Misc. No.49439 of 2014 (4) dt.17-04-2015 to release the petitioner on bail and hence, his prayer for bail in connection with Pratapganj P.S. Case No. 59 of 2014 pending in the court of Judicial Magistrate, Birpur, Supaul stands rejected. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
