====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 09-05-2025 Heard Mr. Shailesh Kumar, learned counsel for the petitioner and Mr. Binay Krishan, learned Special P.P. for the State.

2. Petitioner seeks regular bail in connection with Gurua P.S. Case No. 419 of 2023 dated 04.09.2023 registered for the offences punishable under Sections 342, 354(B), 323, 504, 506/34 of the Indian Penal Code and Section 8 of the POCSO Act and Sections 3(i)(w)(r)(s) and 3(2)(v) of the SC/ST (POA), Act.

3. The main submissions advanced by petitioner's counsel are that the petitioner has got no criminal antecedent and has been languishing in jail since 25.11.2024, both the parties are neighbours, the entire family members of the

Patna High Court CR. MISC. No.8948 of 2025(4) dt.09-05-2025 2/2 petitioner have been made accused by the informant due to the previous enmity and a false story was concocted by the informant with the help of his minor daughter. It is further submitted that against the petitioner, investigation has been completed.

4. No one appears on behalf of the O.P. No. 2.

5. Learned APP appearing for the State has opposed the bail prayer of the petitioner and submitted that the victim has supported the allegations in her statement recorded by her before the Judicial Magistrate.

6. In the facts and circumstances of this case as well as considering the aforesaid submissions and mainly the fair and clean antecedent of the petitioner and his custody period and also the completion of investigation against him, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Gurua P.S.
