The petitioners, two in number, seek their bail in Tarabari P.S. Case No. 86 of 2012 under Sections 364, 366(A)/34 of the Indian Penal Code.

Shamsa Khatoon, mother of the victim Ajmari Khatoon, lodged this case when her daughter did not return. The informant came to know that the petitioners and others were seen taking her daughter in an auto rickshaw. Sri Ambika Bhagat, learned counsel for the petitioners, submits that the Chawkidar had developed illicit relation with the wife of Sukhdeo Manjhi, which the petitioners objected, that is why, the petitioners have been falsely implicated in the case.

During the course of investigation, the witnesses

Patna High Court Cr.Misc. No.37873 of 2014 (4) dt.17-04-2015 2/2 have also stated that the petitioners were seen taking the minor daughter of the informant in an auto rickshaw. The victim is still traceless. It also transpired that the petitioners are indulged in such activity of kidnapping of minor children.

Considering the facts aforesaid, I am not inclined to enlarge the petitioners on bail. Accordingly, the same is rejected at this stage.
