JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code.

It is alleged that the informant gave ornament worth `4,50,000/- to the petitioner for polishing but ornaments were not returned and thereby the petitioner misappropriated the same. It is submitted by learned counsel for the petitioner that the informant did not pay the wages for doing earlier polishing work and in order to save his own skin, as the petitioner threatened to lodge a money suit then the present case has been lodged. It is further submitted that there is nothing on record to suggest that any endorsement of jewellery was made by the informant to the petitioner.

No.3550 of 2016 (2) dt.22-01-2016 2/2 Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Town P.S. Case No. 639 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
