The petitioner seeks bail in Bachhwara P.S. Case No. 247 of 2021, registered for the offence punishable punishable under Sections 188, 120(B) and sections 30(a)(c), 36 of the Bihar Prohibition and Excise Act, 2018.

180 litres of country made liquor has been recovered from Diyara and this petitioner was seen fleeing away from the place of recovery and the local Chowkidar identified him. It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from public place and petitioner has got no concern with the seized liquor. Petitioner claims clean antecedent and he is in

Patna High Court CR. MISC. No.9474 of 2022(2) dt.18-04-2022 2/2 custody since 19.11.2021. Investigation is complete. Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Judge-I, Begusarai in connection with Bachhwara P.S. Case No. 247 of 2021.
