JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 302/34 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that on the order of the petitioner, coaccused Sonu Kumar Sah and Manish Sah opened fire from pistols causing fire arms injuries to Ranjeet Choudhary (father of the informant) and Sunil Paswan. Father of the informant died on the spot.

Learned counsel appearing for the petitioner submits that the petitioner is only order giver and he is not the assailant. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.9289 of 2023(2) dt.12-05-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate First Class cum Additional Munsif, Samastipur in Kalyanpur Police Station Case No. 303 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
