JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named and it appears that in course of investigation, one co-accused, Raju Kumar was arrested in connection with another case and confessed his involvement in the present case and also disclosed the name of the petitioner. Subsequently, the confessional statement of other accused including the petitioner was recorded and they, too, confessed their guilt. Admittedly, nothing has been recovered from conscious possession of the petitioner nor petitioner has been put on Test Identification Parade as yet.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.56951 of 2015 (2) dt.17-12-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 39 of 2015.
