JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-01-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Fatuah P.S. Case No. 280 of 2016 registered for the offences punishable under Sections 379, 120B of the Indian Penal Code. Allegedly, the petitioner being the driver of Auto bearing Registration No. BR01PF-8657 made the vehicle traceless. Submission is of false implication and that the petitioner has been made victim of circumstances, he was demanding his wages and left the job of the informant and thereafter, his tempo was stolen away by some unknown thief and taking advantage of the situation he implicated the petitioner, resulting the petitioner is suffering in custody since 28.07.2016, chargesheet has already been submitted and there is no chance of tampering with the prosecution evidence.

Patna High Court Cr.Misc. No.1968 of 2017 (2) dt.20-01-2017 Learned APP opposes the prayer of bail by submitting that the petitioner is named in the FIR.

In the facts and circumstances stated above, considering that there is no allegation of tampering with prosecution evidence, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Md. Jabeen Jamaal, J. M. Ist Class, Patna City in connection with Fatuha P.S. Case No. 280 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
