The petitioners apprehend their arrest in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code and section 8 of the POCSO Act. Prosecution case in brief is that co-accused Panchanand Das kidnapped the minor daughter of informant. When the informant went to the house Panchanand Das to complain, these petitioners and others abused her. It is submitted that petitioners have been falsely implicated in this case simply because petitioner no. 1 is brother

Patna High Court CR. MISC. No.10838 of 2023(2) dt.27-04-2023 2/2 and petitioner no. 2 is mother of co-accused Panchanand Das. There is general and omnibus allegation. Specific accusation of kidnapping is against co-accused Panchanand Das who is already in custody. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge Judge VI, Banka in connection with Rajoun P.S. Case No. 429 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
