2. The petitioner seeks bail in a case registered for offence under Sections 366(A)/34 of the Indian Penal Code.

3. As per prosecution case, all the F.I.R. named accused persons including this petitioner kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely because he happens to be father of co-accused Mukesh Kumar. The victim, in her statement recorded under Section 164 Cr.P.C., has denied the prosecution case and has specifically stated that she has voluntarily left the house and has solemnized marriage with co-accused Mukesh Kumar. Some of the similarly situated co-accused persons have been granted anticipatory bail by this

Patna High Court CR. MISC. No.12969 of 2024(6) dt.18-10-2024 2/2 Court, vide order dated 31.07.2024 passed in Cr.Misc. No. 20415 of 2024. Petitioner has got clean antecedent and is in custody since 08.11.2023.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the statement of the victim recorded under Section 164 Cr.P.C. and period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 900 of 2023.
