JUSTICE CHAKRADHARI SHARAN SINGH) 05-05-2022 Mr. Munna Prasad Dixit, learned counsel for the petitioner, after some argument decides not to press this application against the order of the Central Administrative Tribunal, Patna Bench, whereby the Tribunal has declined to proceed against the officials of the Railway under Section 17 of the Administrative Tribunals Act, 1985 which confers upon the Tribunal jurisdiction to punish for contempt of the Tribunal. Mr.

Dixit accordingly seeks permission to withdraw this application with a liberty to approach the Tribunal for redressal of such grievance of these petitioner which remained unfilled because of delay on the part of the respondents in implementation of the order of the Tribunal, violation of which was alleged in the CCPA No. 71 of 2006. He submits that withdrawal of the contempt application may not prohibit the petitioners from questioning the correctness of communication dated 16.11.

Patna High Court CWJC No.6680 of 2020(12) dt.05-05-2022 3/3 dated 07.09.2017 passed in CCPA No. 71 of 2006. This application is accordingly dismissed as withdrawn. It is observed that withdrawal of this application shall not preclude the petitioners from approaching appropriate forum under appropriate provision of law raising their grievance(s) in accordance with law.
