The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, a total of 4410.360 liters of IMFL was recovered from a truck and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has no concern either with the vehicle in question nor with the seized vehicle. He is in custody since 8.1.2021 and has no criminal antecedent.

No.20464 of 2021(3) dt.30-09-2021 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Sadar P.S. Case no.8 of 2021 (Special Excise Case no.22 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Purnea.
