2. The petitioner seeks regular bail in connection with Gamhariya P.S. Case No. 26 of 2024, registered for the offence punishable under Section 21(C) of the NDPS Act.
3. As per prosecution case, informant received a secret information that illegal cough syrup was carried by a Innova car bearing registration no. BR01PE-5447. The informant along with other police personnel reached at the spot and started checking vehicles and upon seeing the police personnel, vehicle riders tried to flee away from the place of occurrence but was apprehended at the spot and from the possession of the petitioner 3,000 pieces of Wiscof Cough Syrup each containing
Patna High Court CR. MISC. No.14166 of 2025(2) dt.28-02-2025 2/2 100 ml, kept in 15 bags and two mobile phones were recovered from the said car. The total quantity of cough syrup recovered is 300 litres. He could not produce any valid document to carry the said quantity of contraband syrup.
4. Learned counsel for the petitioner submits that this is a second attempt of the petitioner of prayer for regular bail before this Court. Earlier, prayer of the petitioner for regular bail is already rejected by this Court vide order dated 05.08.2024 passed in Cr. Misc. No. 32514 of 2024.
5. There is no fresh ground to reconsider the prayer for regular bail of the petitioner. Hence, prayer for regular bail of the petitioner is hereby rejected
6. However, Trial Court is directed to expedite the trial as early as possible.
