The petitioner is accused in connection with Siwan Rail P.S. Case No. 39 of 2016, registered under Section 47 of the Bihar Excise Amendment Act, 2016.

The accusation is that petitioner along with Guddu Pandey were apprehended by the Police at Railway Platform, Siwan with three bags. On search, 72 bottles, each containing 750 ML India made foreign liquor recovered.

Learned counsel for the petitioner submits that, in fact, when petitioner got down from the train at Siwan Railway Station to go in his relation, he was apprehended by the Police showing recovery of the alleged liquor at platform. The petitioner has no criminal antecedent is in custody since

Patna High Court Cr.Misc. No.4811 of 2017 (2) dt.28-02-2017 2/2 04.08.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate (Railway), Sonpur, District-Saran in connection with Siwan Rail P.S. Case No. 39 of 2016.
