The petitioner seeks bail in connection with Pakaridayal P.S. Case No. 123 of 2022 instituted for the offence under Sections 147, 148, 149, 341, 342, 447, 307, 324, 323, 326, 120(B), 504 & 506 of the Indian Penal Code. 3.

As per the prosecution case, all the accused persons including this petitioner assaulted the informant and his brother, due to which they sustained multiple injuries. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 04-12-2023. Petitioner

Patna High Court CR. MISC. No.13798 of 2024(2) dt.06-03-2024 2/3 bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation against the petitioner. There is general and omnibus allegation levelled against the petitioner. It is submitted that there is subsisting land dispute between the parties. There is case and counter case between the parties. Charge sheet has already been submitted in this case. Other coaccused has been granted anticipatory bail by Co-ordinate Bench of this Court vide order dated 06-04-2023, passed in Cr. Misc. No. 74898 of 2022.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, fact that there is no direct allegation against the petitioner, charge sheet being submitted and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of
