JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this Court on the ground that he was identified by the witnesses in course of investigation but by referring Annexure-3 series to the petition, learned counsel for the petitioner submits that so-called witnesses, who claimed to have identified the petitioner, have turned hostile in course of trial and they have not supported the prosecution case and, therefore, there is nothing on the record to show the involvement of the petitioner in the present

No doubt, petitioner carries criminal antecedent but taking note of the aforesaid changed circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Samastipur in connection with Chakmehsi P.S. Case No. 56 of 2015.
