The petitioner seeks bail in anticipation of his arrest in connection with Nawada Town P.S. Case No. 137 of 2016 dated 03.03.2016 instituted for the offences under Sections 419/420 of the Indian Penal Code and Section 3(X) of the Bihar Examination Control Act.

In place of petitioner, one Sanjay Kumar was writing in the Intermediate examination.

Hence the prosecution.

Considering the nature of accusation, I am not inclined to grant anticipatory bail to the petitioner who had sent

Patna High Court CR. MISC. No.20374 of 2021(2) dt.21-04-2022 2/2 another person to appear on his behalf in the examination. The prayer for anticipatory bail of the petitioner is rejected.

However, if the petitioner surrenders before the court below and seeks bail, the court below shall take into account the fact that the petitioner could not take advantage of his scheme and that he is a young person who shall mend his ways in future and shall pass orders in accordance with law without being prejudiced by the facts that the present application has not been entertained by this Court.
