Petitioner is accused in connection with Sugauli P.S. Case No. 176 of 2015 arising out of Tr. No. 1784 of 2015 registered under Section 414 of the I.P.C.

The petitioner and one Nausad Alam were apprehended by the Police, who started to flee away leaving motorcycle and admitted that the motorcycle is stolen one. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the petitioner is not apprehended by the Police along with motorcycle, rather he was arrested by the Police nearby the motorcycle, which is said to be stolen one. Patna High Court Cr.Misc. No.57535 of 2015 (2) dt.13-01-2016 2/2 Naushad Alam has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 34927 of 2015 on 21.08.2015. It is further submitted that petitioner has no criminal antecedent and is in custody since 22.05.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sadar, Motihari, East Champaran in connection with Sugauli P.S.
