Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is/are apprehending his/their arrest in connection with Kotwali P.S. Case No. 211 of 2020 for the offence registered under Sections 147, 148, 149, 337, 338, 224, 225, 307, 353, 420 and 120B of the Indian Penal Code and Section 11 of Bihar Gambling Act and Section 7 of Lottery (Regulation) Act, 1998.

Allegation, as alleged against the petitioner is that he is engaged in running and illegal a single digit lotter and

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He was not apprehended on the spot. It is further submitted that no incriminating articles has been recovered from the conscious and constructive possession of the petitioner. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 211 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. Further condition is that one of the member should be a close family member of the petitioner.
