JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 5 24-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.
Petitioner is in jail custody since 02.02.2015 in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
Petitioner is not named but in course of investigation, he was arrested and confessed his guilt disclosing his involvement in the present case. Furthermore, near about after more than one year, two witnesses disclosed that they learnt the name of petitioner and others.
It appears that except aforesaid material, there is nothing against the petitioner. Moreover, having more or less similar allegation one co-accused, namely, Chandan Kewat @ Ashok
Patna High Court Cr.Misc. No.30101 of 2015 (5) dt.24-11-2015 P2/2 Kewat has already been granted privilege of bail by a co-ordinate bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar Muffasil P.S. Case No. 137 of 2015.
