Petitioner happens to be wife of the deceased and is languishing in jail custody since 23.01.2014 in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.
Admittedly, petitioner is not named in the first information report and in course of investigation, her name surfaced in confessional statement of co-accused, Md. Babul who disclosed that at the behest of the petitioner he committed the murder of the deceased. Police also collected call details of the petitioner and co-accused, Md. Babul. It would appear from the
Patna High Court Cr.Misc. No.51795 of 2014 (7) dt.21-04-2015 aforesaid materials that petitioner is said to be only conspirator and she did not take active part in the alleged crime. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Katihar in connection with Sessions Trial No. 132 of 2014 arising out of Kadwa (Balia Belon) P.S. Case No. 22 of 2014.
