JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 The petitioner seeks regular bail in connection with Manjagarh P.S. Case No. 96 of 2019, registered for offences punishable under Sections 30(a) 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 383 litres of liquor from the vehicle of the petitioner.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only because the vehicle from which recovery was made, belongs to the petitioner and the real fact is that the vehicle was in custody of the driver. Further he has no criminal antecedent and has been in judicial custody for more than three months.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts,
Patna High Court CR. MISC. No.7903 of 2020(2) dt.20-02-2020 2/2 let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional District & Sessions Judge, Gopalganj, in connection with Manjhagarh P.S.
