1. Heard learned counsel for the petitioners as well as learned APP for the State.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 332, 333, 353, 427, 504, 506 of the IPC.
3. The learned counsel for the petitioners submit that petitioner no.1 is a person person with clean antecedent and petitioner no.2 has antecedent of one case and the informant
Patna High Court CR. MISC. No.22392 of 2024(2) dt.23-04-2024 2/3 alleges that on information that some accused are indulging in illegal trade of liquor, he reached the place of occurrence where the accused had assembled and on seeing the police force started fleeing and even pelted stones causing injury to the informant and driver of the police vehicle and even the vehicle of the police was damaged.
4. Learned counsel for the petitioners submit that petitioners have been falsely implicated in the present case. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegations are general and omnibus in nature. It is next submitted that petitioners came to be implicated as they reside near the place occurrence.
5. The learned APP opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No.740 of
Patna High Court CR. MISC. No.22392 of 2024(2) dt.23-04-2024 3/3 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
