The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The informant made allegation that his sister was done to death by her husband Rikesh Sharma and his family members and her dead body was thrown in a river. The dead body was recovered. It is submitted that the petitioner is the father-inlaw of the deceased and no specific allegation is made against the petitioner that he ever tortured his daughter-in-law on any account; much less on account of demand of dowry. The deceased was married to the son of the petitioner much prior to 2006 and, after marriage and before death of the deceased, neither the informant nor the deceased ever made any complaint.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.49283 of 2014 (5) dt.21-04-2015 2/2 allegations made against the petitioner and the fact that the petitioner is the father-in-law, who is in jail since21.06.2014, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Vaishali at Hajipur in Lalganj P.S.
