JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

A theft was committed in the house of the informant. Subsequently the informant came to know through villagers that one Javed @ Rinku committed theft. The informant along with others went to Javed @ Rinku who admitted the commission of theft and stated that he kept the stolen articles in the house of Gorelal Manjhi. The informant and others went to the house of Gorelal Manjhi found the stolen attachee but cash and other articles were not found there. Subsequently during investigation police came to know that the place of recovery is the house of the

Patna High Court Cr.Misc. No.2761 of 2016 (2) dt.19-01-2016 2/2 petitioner and not Gorelal Manjhi.

It is submitted by the learned counsel for the petitioner that police maliciously in order to save the skin of Gorelal Manjhi has roped the petitioner in the present case. Statement has been made in paragraph - 3 of the petition that the petitioner has got no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Nawada Nagar P.S. Case No. 455 of 2015 pending in the court of the learned Chief Judicial Magistrate, Nawada.
