JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the First Information Report but it appears from the impugned order as well as materials available on the case diary that there was illicit relation of the petitioner with informant of this case and due to aforesaid illicit relation petitioner as well as the informant having entered into conspiracy got eliminated the deceased.

The trial of the petitioner is going on and, therefore, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Sessions Trial No. 1127 A of 2013, arising out of Bihpur P.S. Case No. 331 of

Patna High Court Cr.Misc. No.3857 of 2015 (4) dt.21-04-2015 2 / 2 2013, pending in the court of 2nd Additional Sessions Judge, Nawgachhia, District Bhagalpur stands rejected. However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
