The petitioner seeks regular bail in connection with Panjawara PS case no. 95 of 2018 registered for the offence punishable under Section 392/34 of Indian Penal Code. The allegation is regarding the informant having gone to Banka branch for depositing money, however on the way, co-accused persons on two motorcycles had intercepted him and snatched a sum of Rs. 1,22,542/-.

The learned counsel for the petitioner submits that the petitioner is innocent, has been falsely implication in the present case and his name has transpired on account of confessional statement made by the co-accused persons namely Ganga kumar. It is further submitted that neither any recovery

Patna High Court CR. MISC. No.12242 of 2019(2) dt.27-02-2019 2/2 has been made from the petitioner nor T.I. parade has been held so as to connect the petitioner with the alleged crime. Lastly, it is submitted that the petitioner is having clean antecedent and he is languishing in custody since 10.11.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Banka in connection with Panjawara PS case no. 95 of 2018.
