JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Altogether eight persons including petitioner are named in the First Information Report and there is general and omnibus allegation against all the accused that they assaulted the deceased with bricks and other weapons. So far as petitioner is concerned, it is stated that he assaulted the deceased by means of Lathi and one co-accused Arun Rai jumped on the belly of the deceased. The post-mortem report of the deceased reveals that deceased died of his head injury but it is not specific as to who is author of aforesaid injury.

Considering the facts aforesaid, petitioner above named is directed to be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.3686 of 2015 (5) dt.21-04-2015 2 / 2 Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Maner P.S. Case No. 372 of 2014.
