====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Vijaipur P.S. Case No. 80 of 2017, instituted for the offence under Section(s) 420, 409 and 406 of Indian Penal Code.

Counsel for the petitioner submits that there is no defalcation of money by this petitioner.

It is alleged in the written report that petitioner who was In-charge Headmaster of the school along with other accused persons had been allotted work for construction of additional class room in upgraded middle schools for which money had been allotted to them and the same was withdrawn by them, but they have not completed the construction work.

Counsel for the petitioner submits that petitioner has completed the work allotted to him. In this regard, the present Headmaster of the said school has issued certificate dated 12.01.2019

Patna High Court CR. MISC. No.12074 of 2019(2) dt.27-02-2019 2/2 which has been enclosed as Annexure-2. He further submits that during investigation, the present Headmaster of the school in question has reported that the construction work has already been completed at the roof level by the petitioner according to the 1st installment. He has also stated in the report that work of second installment will be done by him. The same thing is mentioned in the certificate of the present Headmaster which has been enclosed as Annexure-2.

Petitioner is in custody since 22.12.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Gopalganj, in connection with Vijaipur P.S. Case No. 80 of 2017, subject to the condition that both the bailors will be close relatives of the petitioner.
