Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that six accused persons including the petitioner brutally assaulted the father of the informant. Subsequent father of the informant succumbed to the injury. Moreover, the father of the informant confessed the name of the accused persons to the informant. It is submitted by the learned counsel for the petitioner that considering the omnibus and general accusation and the fact that though the accusation of assault is against six persons, but three injuries have been found on the victim. Coaccused Bhola Yadav has been granted bail vide Cr. Misc. No.

Patna High Court Cr.Misc. No.1696 of 2016 (2) dt.13-01-2016 13385 of 2013.

In view of this, the aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sabour P.S. Case No. 113 of 2012, pending in the court of learned Chief Judicial Magistrate, Bhagalpur. With this observation this application is disposed of.
