01-07-2020 Heard learned counsel for the parties through video conferencing.

The petitioners apprehend their arrest in Gamharia P.S. Case No. 61 of 2014, G.R. No. 732 of 2014 registered for the offence under Sections 498(A), 323 and 504/34 of the Indian Penal Code.

As per prosecution case, the accusation against these petitioners alongwith other co-accused have tortured the informant physically and mentally due to non-fulfillment of demand of dowry and also for giving birth of two female child. It is submitted on behalf of petitioners that there is general and omnibus allegation and there is no specific overt act

Patna High Court CR. MISC. No.11673 of 2020(2) dt.01-07-2020 2/2 against petitioners, who are father-in-law and mother-in-law of informant respectively. It is further submitted that petitioners are living separately and they have nothing to do with the affairs of informant and her husband (son of petitioners), but since they are in-laws members, they have falsely been made accused. The husband of the informant has already been granted regular bail by the court below itself.

Considering the aforesaid facts and circumstances, the bail application is allowed.

In the event of arrest or surrender within a period of six weeks from today, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhepura in connection with Gamharia P.S. Case No. 61 of 2014 (G.R. No. 732 of 2014), subject to condition as laid down under Section 438(2) of the Cr.P.C.
