The petitioner apprehends his arrest in a case registered for the offence under Section 30(a), 37(c) of Bihar Prohibition and Excise Act.

5 liters of Mahua liquor has been recovered from outside the house of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered either from the conscious possession or premises of the petitioner and he has been made accused only on suspicion. Recovery has been made from an open place outside the house of petitioner, which is accessible to general people. Petitioner has no criminal antecedent.
