The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,354 and 504 of the Indian Penal Code.

It is alleged that when the niece of the informant went to ease out, the petitioner attempted to outrage the modesty and abused. When the mother of the informant reached on alarm then she was also assaulted.

It is submitted by the learned counsel for the petitioner that the petitioner being neighbour of the informant has been roped in the present case due to drainage dispute and no specific overt act has been alleged in the FIR. Statement has been

Patna High Court Cr.Misc. No.1641 of 2016 (2) dt.13-01-2016 2/2 made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid submission, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Shahpur P.S. Case No. 123 of 2015 pending in the court of learned JM Ist Class, Danapur, Patna. This application is disposed of with the aforesaid observation/direction.
