Petitioner apprehends his arrest in a case registered under Sections 341, 323, 307 of the Indian Penal Code. Informant has alleged in his written complaint that that on 08.11.2019 at about 9.30 PM his younger brother who is disable and mentally unsound was returning to his house after attending feasts, petitioner started assaulting him, as a result of which he sustained injury.

It has been submitted on behalf of petitioner that petitioner is innocent and has been falsely implicated in this case due to animosity and previous dispute. The incident is of 08.11.2019, however, FIR was instituted on 11.11.2019. The nature of injury found on the victim is also of simple in nature.

Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Giriyak P.S. Case No. 390 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
