The petitioners seek pre-arrest bail in connection with Pakaribarawan P.S. Case No. 194 of 2015 registered under Sections 304-B read with 34 of the Indian Penal Code. It is contended that though in the first information report, it has been alleged that the deceased was married to one Ajay Prasad about six years ago, the witnesses, whose statements have been recorded in para 8, 9 & 10 of the case diary categorically stated that the deceased was married to Ajay Prasad about 10-12 years prior to her death. It is further
Patna High Court Cr.Misc. No.2183 of 2016 (3) dt.11-04-2016 2 / 2 contended that the deceased died a natural death and the doctor who conducted the autopsy on the body of the deceased did not find any external or internal injury.
Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioners. He has contended that the offence is quite serious in nature and investigation is still going on.
Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioners, who are sister-inlaws of the deceased, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Pakaribarawan P.S. Case No. 194 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
