No doubt, petitioners were arrested from a room in which other accused were arrested and several incriminating articles were recovered but from bare perusal of the first information report itself, it is obvious that it was co-accused Amit Kumar and some others who were master mind of the alleged crime and so far as the petitioners are concerned, it appears that they were only scholars. Petitioners are in jail custody since 4.10.2015 without having any criminal antecedent.

Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar V, Judicial Magistrate, Ist Class, Patna/ concerned court in Gardanibagh P.S.
